This website Lawgitech.eu (hereafter referred to as the “site” or “Lawgitech”) is owned by civil society in the form of private limited liability Digilaw civil society whose company number is 0675487115 and the head office is located at 1000 Brussels, Michelangelo Avenue 86. The company is also the site’s publisher and owner of the Lawgitech brand under which it operates.
The applicable terms and conditions are those in effect on the date of use by users/Clients of the Lawgitech Site or the order of a service, the company reserves the right to change at any time these terms and conditions. These changes will take effect when they are posted on the site. By accessing the Site, the User is deemed to have accepted without reservation or restriction the changes that would have taken place in this way.
For the purposes of these CGs, the terms are defined as:
- “User”: Any natural person browsing the Site.

1. LAWYERS’ ONLINE LEGAL SERVICES
1.1. WHO ARE LAWGITECH’S LAWYERS?
Civil society lawyers in the form of private limited liability Digilaw are referenced on LAWGITECH.
1.2. WHO IS THE ONLINE LEGAL SERVICES FOR?
DIGILAW/LAWGITECH is primarily aimed at:
(1) entrepreneurs and professionals to look after their interests, from the creation of their company to the marketing of their products or services, through the promotion of their contributions ;(2) to innovative companies and startups, in projects involving commercial law and in particular the transfer of technology and/or know-how (cessions, licenses, distribution, franchises, etc.) ;(3) to artists such as musicians, screenwriters, writers, photographers, illustrators, etc., in order to protect and enhance their works.
The Lawyers referenced on the DIGILAW website offer assistance in all legal areas that involve, directly or indirectly, the online activities of the aforementioned persons as long as these activities have an element of attachment to Belgium.
Each of the services ordered on DIGILAW is rendered by one of the Lawyers referenced on DIGILAW (hereafter the Lawyer).
1.3. DEADLINES
The proposed deadlines for services begin to run the day after the firm receives the questionnaire completed by the Client.
A package is provided for each of the services offered on the LAWGITECH website. The package to be paid includes the remuneration and fees of Lawyer as well as VAT.
2. TRANSPARENCY OF FEES, CHARGES AND TAXES
2.1. FIXED PRICE

2.2. VAT ON LEGAL SERVICE
The tariff conditions refer to the duty-free price (HT) of the service and the total price (TTC) of the service.
2.3. PAYMENT BY THE USER OF THE PACKAGE
The payment of the package by the User takes place prior to the completion of the service by the Lawyers. 2.4. RECAP

2.5. BILL
At the end of each service, the Lawyer is required to send an invoice to the Client who made the order on behalf of the latter.
2.6. BELGIAN VAT REFUND

If the customer thinks that he should not pay Belgian VAT because his company is located in a member of the European Union other than Belgium and subject to aself-liquidation, or because his business is located outside of the European Union and that VAT is not due, it should not forget to specify if necessary its intra-community VAT number and the headquarters of its company in the order form. The Lawyers will carry out a preliminary check on their own initiative, if necessary, will reimburse the client as soon as possible the Belgian VAT.
3. END OF RELATIONSHIPS
Each party may terminate relations with the other party with written notification.
In any event, the client remains responsible for the payment of the Lawyers’ fees, fees and disbursements until they cease to act as your counsel.
4. COMMUNICATIONS BETWEEN PARTIES
Lawyers will be able to contact Clients who have ordered online services through email or Skype/WhatsApp to ask them for any additional information useful to their file, considering that they have taken the appropriate measures to ensure the security and confidentiality of communications (including the risk of interception or unauthorized access to such communications or the risk of viruses). The Lawyers of Lawgitech also maintain adequate information security measures.
5. CONFIDENTIALITY AND RELATIONSHIPS WITH OTHER CUSTOMERS
Any information that Users provide to Lawgitech and is not in the public domain will be considered confidential. Lawyers will report this only with their consent or if they are required by law or by a judicial or administrative authority.
6. DOCUMENTATION AND ADVICE
Clients may freely use and copy, for their own use only, all of the notices and documentation that lawyers have written in the course of providing their services, but they must be considered confidential and all intellectual property rights about them will remain their property.
Lawyers keep records of records in accordance with the requirements imposed on them.
7. PROFESSIONAL OBLIGATIONS
7.1. RESPECT FOR ETHICS
The Lawyers of Lawgitech practice a regulated profession subject to ethical standards set by the French and German-speaking Bar Associations (www.avocat.be), and the French Bar Lawyers’ Association of Brussels (www.barreaudebruxelles.be). Additional information on the professional rules that apply to Lawgitech can be obtained from this order.
Any difficulty in complying with the rules of ethics applicable to lawyers may give rise to a complaint to the staff member of the French Bar Association of Brussels. In the event of a dispute over fees, conciliation, mediation and arbitration procedures are also put in place by the competent Order. All information about this can be obtained at the Internet addresses mentioned above.
7.2. IDENTIFICATION OBLIGATIONS
Like other professional service providers, Lawyers subject to strict obligations to identify Clients under the legislative framework anti-money laundering and terrorist financing. In the absence of satisfactory identification, Lawyers are not allowed to start their work and will make a full refund of the package paid by the User as soon as possible.
7.3 NATURE OF THE ADVICE PROVIDED

8. DATA COLLECTION AND PERSONAL DATA PROTECTION
8.1 DATA COLLECTED

This data is used by lawyers for the purposes of providing Consultations to Clients.
8.2 STATEMENTS
The S.P.R.L. Digilaw is responsible for processing users’ data collected on the website Lawgitech.

Permission to Digilaw S.P.R.L. to process data User’s personal information is requested before any data collection by the bais of a validation check-box on the website Lawgitech.

9. EXTENT OF RESPONSIBILITY
9.1. LIMITATION OF RESPONSIBILITY FOR CONTINUED ACCESS TO THE DIGILAW SITE
Civil society in the form of a private limited liability company Digilaw makes every effort to ensure continued access to the site Lawgitech.
However, it does not offer any guarantee of continuity, as continuity can be dependent on third parties (such as an access provider, a host, an energy supplier).

In any event, the liability of the Lawyers cannot be incurred if the performance of one of the obligations is prevented or delayed due to a case of force majeure, and in particular in the event of interruption or malfunction of the telecommunications or energy networks, fire, natural disaster.
9.2. LIMITATION OF PROFESSIONAL RESPONSIBILITY AND FORCE MAJEURE
The professional responsibility of Digilaw/Lawgitech for any damage, loss or cost borne by the customer in connection with their intervention is limited to the amount of their insurance coverage as specified in Article 10.3 of these terms and conditions.
Under no circumstances can the liability of the Lawyers be questioned by a third party.
9.3. PROFESSIONAL LIABILITY INSURANCE
Professional civil liability is carried out by the company chosen by the Order of French and German-speaking Bars, namely currently ETHIAS Common Law, headquartered at 4000 Liège, Rue des Croisiers, 24. The insured capital is 1,250,000 euros per loss, all damages combined. The geographic coverage of insurance is global, excluding liability actions under the law or jurisdiction of Canada and the United States.
10. CONTENT BROADCAST BY THE SITE
Civil society in the form of a private limited liability company Digilaw holds the intellectual property rights of the overall brand structure and website lawgitech, its contents.
Unauthorized reproduction of its name and distinctive logos and signs constitutes infringement punishable by civil and criminal penalties.
In particular, any representation, reproduction, modification, or more generally any full or partial exploitation of the Site, its content or services, its name, its logos, trade names, acronym, domain names, without the prior and express permission of the Lawyers, is strictly prohibited; regardless of the support and process used.
11. SCOPE OF AGREEMENT
These terms and conditions of intervention replace any agreement and exclude the application of the client’s possible general or specific conditions.
12. ACCEPTANCE
Any request for intervention from the Lawyers that the client has requested on the site Lawgitech requires prior acceptance of these terms and conditions. They prevail over all other general conditions of the customer, unless otherwise agreed.
13. APPLICABLE LAW AND JURISDICTION
These general conditions of intervention, their interpretation and implementation are subject to Belgian law.
Any dispute over civil society intervention in the form of a limited liability private company Digilaw or lawyers for DIGILAW/ LAWGITECH will be brought exclusively to the relevant courts in Brussels.
